So what is personal injury?

Personal injury arises from a situation in which a person is physically injured, suffers emotional anguish or trauma due to the fault of others. When this situation arises and a party is determined to be legally at fault for injuring another party, the party at fault may be made to pay the injured party damages. Our attorneys are here ready to help you file a personal injury claim and guide your through the legal process.

What are damages?

Damages are sums of money the law imposes for a breach of some duty. A breach of duty can be in regards to negligence or a failure on a party’s behalf to keep their moral, contractual, or safety obligations.

In regards to personal injury, damages are usually delegated as a monetary amount owed.

  • Compensatory damages, also known as money damages, are intended to compensate the injured party for their loss or injury. This is the most common type of damages awarded in personal injury cases, which seeks to return the injured party to the condition in which they existed before the injury. These monies are meant to cover medical costs, funeral expenses, or other compensation for pain and suffering.
  • Incidental damages also seek to return the injured party to the condition in which the existed before the injury, and may include coverage for property damage and other incidental costs associated with the injury.
  • Punitive damages seek to punish those who have acted illegally, negligently or maliciously; punitive damages also seek to deter the party at fault from harming others in the future with hefty monetary fines and compensations.
